Public Offer of Legal Entity LLP "Pleep"
This public offer (hereinafter – the Offer) is a Contract concluded between the Contractor and the service user - individual and/or legal entity (hereinafter - the Customer), which defines the conditions for purchasing and providing services using the Contractor's resources.
Terms And Definitions
Tariff validity period - the period during which the Customer has the right to use services purchased from the Contractor under the selected tariff.
Data processing – a set of actions with personal data, including collection, storage, use, modification, transfer and deletion.
Confidential information - information provided by the Customer or obtained by the Contractor in the process of providing services, which shall not be disclosed without the Customer's consent.
AI salesrep (also "Software", "Software Product", "Product") - Software developed by the Contractor that performs automation and user interaction functions within the specified functionality.
Tariff - a package of services offered by the Contractor and described on the website, which can be purchased by the Customer for an established price.
Website – the website owned by the Contractor and located at the web address: https://pleep.app.
Service - this is the Contractor's information system developed to provide specific information services on the Internet.
General Provisions
The Contractor publishes this Offer with a proposal addressed to individuals and legal entities in accordance with Articles 395, 396 and 447 of the Civil Code of the Republic of Kazakhstan (hereinafter – CC RK).
This Offer, like any Contract, defines the essential conditions of interaction between the Contractor and the Customer (the person who accepted the Offer).
This Offer is concluded between the Contractor and the Customer at the moment the Customer purchases a tariff for service provision.
The Offer may be accepted by any individual or legal entity on the territory of the Republic of Kazakhstan who intends to order (purchase) services provided by the Contractor in accordance with the list of services specified on the website https://pleep.app/pricing.
The Customer unconditionally accepts all conditions contained in the offer in its entirety (i.e., in full and without exceptions).
In case of acceptance of the terms of this Offer, an individual or legal entity becomes a Customer.
Acceptance is the receipt by the Contractor of a message about the intention of an individual or legal entity to order services on the terms proposed by this Offer, expressed in making payment for the specified tariff on the website https://pleep.app.
The Offer, all changes, appendices to it, as well as all additional information about the Contractor's services are published on the website https://pleep.app.
Status Of The Contractor's Website
The website is the property of the Contractor and is intended for organizing a remote method of selling services via the Internet.
By accepting the Offer (i.e., paying for an order placed on the Contractor's website), the Customer will receive services on the terms and in the manner determined by the Contract for the provision of the Contractor's services, posted on the website https://pleep.app/terms-of-use.
The Contractor is not responsible for the content and reliability of information provided by the Customer when purchasing a tariff on the Contractor's website.
Customer Status
The Customer is responsible for the reliability of information provided when purchasing a tariff, and its freedom from third-party claims. The Customer also confirms that they have all necessary powers to provide all information necessary for registration and creation of an AI salesrep.
The Customer understands and realizes all functionality, capabilities and features of the Software, and also takes responsibility for possible incorrect operation of the AI salesrep due to combination with other software.
The Customer confirms their agreement with the conditions established by this Offer by marking the box "I agree to the terms of the contract and offer" when purchasing a tariff. They also agree to the terms of the Contractor's Privacy Policy provided at https://pleep.app/privacy-policy.
Information provided by the Customer is confidential. The Customer, by providing their personal data, registering on the website or filling out an application, gives their consent to the processing of their personal data for the purpose of fulfilling the user agreement. The Contractor uses information about the Customer exclusively for the purposes of the Contractor's functioning (sending notifications to the Customer about order fulfillment, etc.) and in cases specified in this Offer.
Using the Contractor's website (resource) to view and select services, as well as to purchase a tariff, is free for the Customer.
Subject Of The Offer
The Contractor, based on the Customer's consent and application specified on the website https://pleep.app, undertakes to provide services in accordance with the conditions and at prices established by the Contractor on the website for providing access to Software presented as an AI salesrep.
The Contractor's obligations under this Contract are considered fulfilled at the moment of providing the Customer access to the Software tariff purchased by the Customer.
Provision of services ordered and paid for by the Customer is carried out personally by the Contractor or by third parties engaged by the Contractor to fulfill their obligations.
The provisions of the CC RK, the Law of the Republic of Kazakhstan "On Consumer Rights Protection", as well as other regulatory legal acts of the Republic of Kazakhstan regulating the rights and obligations of the Parties specified in this Offer apply to relations between the Customer and the Contractor.
An individual or legal entity is considered to have accepted all terms of the Offer (acceptance) and its appendices in full and without exceptions from the moment the Contractor receives a message about the Customer's intention to order services on the terms proposed by the Contractor, i.e., payment for the service specified according to a particular tariff independently chosen by the Customer on the website https://pleep.app. In case of acceptance of the Offer, an individual or legal entity is considered to have concluded a Service Agreement with the Contractor and acquires Customer status.
All rights to the AI salesrep, access to which is provided as part of service provision, belong to the Contractor, unless otherwise agreed by the parties in writing.
Contract Conclusion Procedure
The Customer can select and purchase a tariff independently on the Contractor's website in the pricing section (https://pleep.app/pricing).
When purchasing a tariff on the Contractor's website, the Customer must perform the following steps:
Register on the service
Select the necessary tariff and purchase it (payment procedure description)
The Customer's expression of will in the process of ordering and preparing an AI salesrep is carried out by the Customer entering appropriate data into the order form on the Contractor's website, or by submitting an application through a Contractor specialist using information and telecommunications means or by email contact@pleep.app.
The Contractor does not edit information about the Customer and uses it for the purpose of fulfilling their obligations under this Contract in the form and content in which it was provided by the Customer.
To obtain a paper copy of the Offer Contract for service provision, the Customer sends an application by email or other means agreed with a Contractor specialist at the address specified on the Contractor's website.
Tariff Information
Information about the Contractor's tariffs is displayed on the Contractor's website through text and graphic elements, and is also the property of the Contractor.
Each tariff is accompanied by textual information with conditions, price and description of the provided service.
All informational materials presented on the Contractor's website are for reference purposes and cannot fully convey information about the properties and characteristics of services. In case the Customer has questions regarding the properties and characteristics of tariffs, the Customer should contact a Contractor specialist using the contacts specified on the website before purchasing a service or subscription.
Service Purchase Procedure
The Customer has the right to purchase only one of the presented tariffs available on the Contractor's website. The Customer does not have the right to purchase more than 1 (one) tariff and have multiple tariffs at the same time.
A tariff can be purchased on the website in the pricing section, or through an invoice issued by the Contractor. To receive an invoice, the Customer must contact the Contractor through the contacts specified on the website.
After purchasing a tariff, the Customer receives access to the service with functionality specified in the tariff within 30 (thirty) minutes. If the Contractor does not receive the promised functionality, they must contact the Customer through contacts to resolve this issue.
The service provision period under the tariff is 30 (thirty) calendar days from the payment date. After this period expires, the tariff cost will be charged to the Customer's card or a new invoice will be issued for payment to continue service provision.
Service Prices
Prices specified on the Contractor's website are indicated in USD.
The price specified on the website may be changed by the Contractor unilaterally, while the price for a tariff purchased by the Customer is subject to change from the next billing moment.
The cost of services provided to the Customer when ordering them on the Contractor's website is specified in the "Pricing" section.
Service Payment
Payment methods and procedures are specified on the website in the "Pricing" section. If necessary, the order payment procedure and conditions are agreed upon by the Customer with a Contractor specialist. Tariff payment by cash is not made.
Cashless payment is made at the moment of tariff payment. After payment processing, all functionality described in the tariff purchased by the Customer becomes available.
The Customer pays for the order by any method available on the Contractor's website.
Party settlements when paying for an order are carried out in tenge of the Republic of Kazakhstan provided that the Customer is a resident of the Republic of Kazakhstan.
In case of purchasing Contractor Services by a Customer who is a non-resident of the Republic of Kazakhstan, payment may be made in foreign currency at a cost equivalent to the Services cost established in tenge at the National Bank of the Republic of Kazakhstan exchange rate at the time of purchasing such Service.
The tariff validity period is 30 (thirty) calendar days from the payment date. After this time expires, the Contractor will charge the tariff amount from the Customer's card specified when paying for the order to extend the tariff validity. If funds are not charged, the Customer will lose access to the tariff functionality within 3 days after the tariff expires. The Customer can resume tariff validity at any time.
The Customer can cancel the subscription at any time by going to the personal cabinet by visiting dashboard and clicking on the profile in the top right corner (https://app.pleep.app/dashboard).
Subscription Refund
The Customer does not have the right to refuse services performed (provided) in a proper manner.
Refund of funds is possible only in the following cases:
If Services were not provided within the timeframes stated in this offer;
If the Contractor did not provide access to the Software;
Significant defects in the AI salesrep's operation were identified, which the Contractor could not eliminate within 5 (five) working days from receiving notification from the Customer. A significant defect is such an error in Software operation that prevents the AI salesrep from functioning in accordance with information stated on the website.
Services are considered properly provided in accordance with paragraph 4.2 of this Offer, i.e., when providing access to the AI salesrep after receiving payment from the Contractor.
The Customer must preliminarily familiarize themselves with this offer, as well as with the capabilities and functionality of the AI salesrep specified on the Contractor's website. In case of questions regarding the functionality and capabilities of the Software or other questions regarding the Software, the Customer has the opportunity to contact the Contractor's technical support or write to the Contractor's email contact@pleep.app.
Party Liability
The Parties bear responsibility in accordance with RK legislation.
The Contractor is not liable for damage caused to the Customer due to improper use of service results ordered on the Contractor's website.
The Contractor is not liable for the Customer's failure to achieve expected results or other subjective criteria for evaluating the AI salesrep's work if functionality corresponds to the description.
The Contractor is not liable for:
Errors or failures in AI salesrep operation caused by incorrect use by the Customer.
Functionality limitations related to features of the Customer's equipment or software.
Direct or indirect damage caused by using the assistant if these risks were previously stipulated or related to force majeure circumstances such as Internet failures, server malfunctions, etc.
Customer's violation of RK legislation when using the AI salesrep.
The Customer is responsible for providing correct and complete data necessary for assistant configuration in RK.
Interference with the assistant's program code, unauthorized modification or transfer to third parties leads to cancellation of the Contractor's obligations under this Contract.
The Customer undertakes to use the assistant exclusively within its functionality and in accordance with legislation.
In case of claims regarding assistant functionality, the Customer undertakes to provide the Contractor with access to the system on which they use the assistant and other materials for analysis and troubleshooting.
Parties are released from liability for non-performance or improper performance of Offer obligations during force majeure circumstances.
Other Conditions
Norms defined by the legislation of the Republic of Kazakhstan apply to relations between the Customer and the Contractor.
If necessary, the Contractor and Customer have the right at any time to execute a service agreement in the form of a written bilateral agreement that does not contradict the provisions of this Offer.
In case of questions and claims from the Customer, the latter must contact the Contractor at the Contractor's location address: Kazakhstan, Almaty city, Medeu district, Bazarbayeva street, house 23, and/or at email address: contact@pleep.app and/or phone number: +7 777 155 5416, including those specified on the Contractor's website.
This Offer comes into effect from the date of its acceptance by the Customer and is valid until full fulfillment of obligations by the Parties.
All disputes and disagreements arising during the Parties' fulfillment of obligations under this Offer are resolved through negotiations, and if it is impossible to settle them through negotiations, the Parties have the right to apply to judicial authorities of the Republic of Kazakhstan at the Contractor's location for resolution of such disputes.
The Contractor reserves the right to expand and reduce the general service offering on the website, regulate access to ordering any services, as well as suspend or terminate the sale of any services at their own discretion.
